Supreme Court Restricts Right to See Contribution Under Superfund

PRESS RELEASE
WASHINGTON, DC—The Supreme Court has limited the ability of parties who clean up contaminated property to obtain reimbursement from those who caused the contamination. In Cooper Industries v. Avial Services, the Court found that a clean-up party could only bring a CERCLA contribution claim if the party seeking contribution for cleanup costs had been subject to a civil action requiring cleanup.
